1. Agreement to Terms

By opting in to receive SMS text messages from Last Nerve Tattoo (“we,” “us,” “our”), you (“you,” “user,” “subscriber”) accept these SMS Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not enroll in or continue the SMS program.

2. Program Description

Our SMS program sends appointment‑related messages—including confirmations, reminders, and missed‑appointment follow‑ups—per appointment, typically one to three texts in total. We do not send recurring promotional campaigns unless you separately and explicitly opt in to marketing messages.

3. Opt‑In Methods

You may subscribe in three ways. First, when booking at https://lastnervetattoo.com/booking

 you can check an unchecked consent box that reads: “I agree to receive appointment‑related SMS from Last Nerve Tattoo. 1–3 msgs per appointment. Msg & data rates may apply. Reply UNSUBSCRIBE to cancel.” Second, you can text START to (518) 347-9518.

Third, you may sign a paper or digital waiver granting SMS consent while in the studio.

4. Opt‑Out & Help Commands

You can opt out at any time by replying UNSUBSCRIBE; after we send a confirmation, you will receive no further SMS messages. For assistance, reply HELP or contact Micah at [email protected] or (518) 347-9518.

5. Message & Data Rates

Standard message and data rates may apply according to your wireless plan. Wireless carriers are not liable for delayed or undelivered messages.

6. Eligibility & Age Restrictions

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to receive tattoo services and to participate in the SMS program. By subscribing, you represent that you meet these age requirements.

7. Your Responsibilities

You agree to provide a mobile number that you own and control, to inform us promptly if that number changes or is reassigned, and not to use our SMS program for unlawful or abusive purposes.

8. Consent to Electronic Records & Signatures

By opting in, you consent to receive disclosures electronically and agree that your electronic acceptance has the same legal force as a handwritten signature.

9. Privacy

We process personal data in accordance with our Privacy Policy. Contact details and consent records are retained for at least four years to comply with CTIA, TCPA, and carrier requirements.

10. Disclaimer of Warranties

SMS services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee message delivery, timeliness, or accuracy.

11. Limitation of Liability

To the fullest extent permitted by law, neither Last Nerve Tattoo nor its affiliates will be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to these Terms or the SMS program, even if advised of the possibility of such damages. Our total aggregate liability will not exceed fifty U.S. dollars (US $50) or the amount you paid us, whichever is less.

12. Indemnification

You agree to indemnify and hold harmless Last Nerve Tattoo, its owners, employees, agents, and service providers—including Twilio Inc. and GoHighLevel LLC—from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your misuse of the SMS program.

13. Modifications to Program or Terms

We may change, suspend, or terminate the SMS program or these Terms at any time. Material changes will be posted here with an updated “Last updated” date. Your continued participation after any change constitutes acceptance of the modified Terms.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of New York, excluding conflict‑of‑law rules. Any dispute will be resolved exclusively through binding arbitration in Albany County, New York, under the Commercial Arbitration Rules of the American Arbitration Association. You waive any right to participate in a class action. Nothing herein limits either party’s right to seek injunctive or equitable relief for intellectual‑property misuse or data‑security breaches.

15. Severability

If any provision of these Terms is held invalid or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.

16. Assignment

We may assign our rights or obligations under these Terms without notice. You may not assign your rights or obligations.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Last Nerve Tattoo regarding the SMS program and supersede all prior or contemporaneous communications.
